If informal resolution is unsuccessful within thirty (30) days, either party may initiate mediation proceedings. The parties agree to participate in good faith mediation before pursuing litigation.

If mediation fails to resolve the dispute within sixty (60) days, either party may commence litigation in accordance with Section 10 above.
